"Users of Apple's iPhones and iPads, including Plaintiffs, were unaware of Apple's tracking their locations and consent to such tracking," the suit argued. "Apple collects the area information covertly, surreptitiously in addition to violations of law."

For its part, Apple answered potential fans and patrons outcry, on the grounds that information was inadvertently logged attributable to "bugs" with the software. In May, Apple released iOS 4.3.3 to patch the challenge.
